Agreement to these terms

These Terms of Service govern your use of the Babylon app and website (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Babylon.

What Babylon is — and isn't

Babylon provides personalized training programs, nutrition targets and suggestions, progress tracking, and an AI coach for everyday guidance.

Babylon is not medical care. The Service offers general fitness and nutrition guidance for generally healthy adults. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for a physician, physical therapist, or registered dietitian. Consult a qualified professional before starting any exercise or nutrition program, especially if you have a medical condition, injury, or are pregnant. If you experience pain, dizziness, or other concerning symptoms, stop exercising and seek medical attention.

Eligibility and your account

You must be at least 18 years old to use Babylon.
You're responsible for the accuracy of the information you provide — your plan and coaching are only as good as what you tell us.
Keep your account credentials secure; you're responsible for activity under your account.

Subscriptions, trials, and billing

Babylon is offered as an auto-renewing subscription purchased through the Apple App Store. Pricing is shown in the app before you subscribe.
Eligible new users may receive a free trial (for example, 3 days). If you don't cancel before the trial ends, the subscription begins and your App Store account is charged.
Subscriptions renew automatically until cancelled. You can cancel anytime in your App Store subscription settings; cancellation takes effect at the end of the current billing period.
Billing, refunds, and payment disputes are handled by Apple under the App Store terms.

AI-generated content

Plans, suggestions, and coach responses are generated with the help of artificial intelligence using the information you provide. AI output can be imperfect or incomplete. Use your judgment — especially about load selection, technique, and how your body feels — and treat the coach's guidance as informed suggestions, not instructions that override common sense or professional advice.

Acceptable use

You agree not to:

Use the Service for anything unlawful, or in a way that could harm Babylon or other users;
Attempt to access other users' data, probe or disrupt our systems, or circumvent security;
Reverse engineer, scrape, or resell the Service or its content;
Use the Service to develop a competing product, including using outputs to train competing models.

Your content

You own the content you submit (logs, photos, messages). You grant Babylon a limited license to host and process that content solely to operate and improve the Service, as described in the Privacy Policy. You can delete your content by deleting your account.

Babylon's property

The Service — including its software, design, branding, and content we create — belongs to Babylon and its licensors. These terms don't grant you any rights to our trademarks or intellectual property beyond using the app as intended.

Referral program

Referral rewards (such as free days of Babylon) are described in the app, may change over time, have no cash value, and may be revoked in cases of abuse (for example, self-referrals or fake accounts).

Termination

You can stop using Babylon and delete your account at any time. We may suspend or terminate accounts that violate these terms or where required for legal or security reasons. Sections that by their nature should survive termination (like disclaimers and limitations of liability) survive.

Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Babylon disclaims all warranties, express or implied, including fitness for a particular purpose, and does not warrant that the Service will be uninterrupted, error-free, or that following any plan will achieve particular results. Physical training carries inherent risk; you assume responsibility for exercising within your abilities.

Limitation of liability

To the maximum extent permitted by law, Babylon will not be liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury arising from your exercise or nutrition choices. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Changes to the Service or these terms

We're always improving Babylon, and features may change. If we make material changes to these terms, we'll notify you in the app or by email before they take effect; continuing to use the Service after that means you accept the updated terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts located in Ontario have exclusive jurisdiction, except where the law of your place of residence grants you mandatory consumer protections.
